What is conveyancing and why instruct a lawyer to buy or sell your property?

Conveyancing is the ‘legal’ part of buying or selling a property or piece of land – which includes the ‘transferring’ of the legal title to the property from the seller to the buyer.

Traditionally, the ownership of property was documented by way of a deed drawn up by a lawyer, and kept in the possession of the owner of the property as’ proof’ of their ownership.

Nowadays the contract contains the details of the agreement between the seller and the buyer; and the transfer document, when lodged at the land registry, has the effect of changing the ownership from seller to buyer.

Since 1990 the registration of all property/land transactions has become compulsory and all entries on the register are open to the public to view.

So, why instruct a lawyer to draw up your contract and submit the transfer document to the land registry?

To be valid, a contract has to include specific, accurate details, and a property lawyer will know how and where to check for these crucial details. A seller’s lawyer has to provide evidence of his client’s legal right to sell the property; whilst a purchaser’s lawyer will check that the property is clear of any practical or financial issues that could have a negative impact on the buyer.

For example – does someone other than the seller have a right to occupy or have a financial stake in the property? Are there any outstanding loans or county court judgement payments secured on the property? These issues must be resolved before contracts are exchanged – otherwise the buyer may find himself responsible for more than just a new property!

Client Satisfaction Survey Analysis Report (5)

This report analyses the contents of all client satisfaction surveys received by the practice from 12th January to 12^th December 2010.

The format of the questionnaire is closely based on the survey suggested by the Lexcel Practice Management standard.

Overall, the findings of this report indicate that Noble Harbour clients expressed a very high level of satisfaction with our services during 2010.

84% of clients rated our reception areas and initial greeting as good or excellent – an increase of 14% in the past year.

98% of clients rated the personal manner of our personnel as good or excellent – an increase of 3% in the past year

Our communications are rated as good or excellent by 95% of clients – an increase of 9% over the past year; with 96% of clients rating our explanations and information as good or excellent- another increase of 2%.

Some 98% of clients reported that they would be happy to/ had already recommended our services to others – another 9% increase during the course of 2010.

Very pleasingly, we appear to have not only maintained, but actually improved upon the last year’s great progress in terms of the clarity of information/advice we provide; and in the manner in which we deliver our service. This is excellent progress in these aspects of our service. The statistics pinpoint our specific, professional strengths; and the client comments in particular, serve to illustrate our excellent level of client care.

Some 4% of clients expressed appreciation for our flexible office opening hours, and of particular note was the gratitude noted for Saturday opening.

Of particular note is the increase in the number of recommendations made by the family, friends and acquaintances of our clients; and the number of questionnaires received from existing clients of the practice who have chosen to re-instruct us in relation to further legal matters – an increase of 3.5%. This is indicative of the local success and increasing establishment of this uniquely progressive five -year old legal practice.
